Online Access Agreement

Agreement

This Agreement is a contract which establishes the rules which cover your electronic access to your accounts at FNB BANK through ONLINE BANKING. By using ONLINE BANKING, you accept all the terms and conditions of this Agreement. Please read it carefully.

The terms and conditions of the deposit agreements and disclosures for each of FNB BANK accounts as well as your other agreements with FNB BANK such as loans, continue to apply notwithstanding anything to the contrary in this Agreement. 

This Agreement is also subject to applicable federal laws and the laws of the State of Kansas (except to the extent this Agreement can and does vary such rules or laws). If any provision of this Agreement is found to be unenforceable according to its terms, all remaining provisions will continue in full force and effect. The headings in this Agreement are for convenience or reference only and will not govern the interpretation of the provisions. Any waiver (express or implied) by either party of any default or breach of this Agreement must be in writing and shall not constitute a waiver of any other or subsequent default or breach. You may not assign this Agreement. This Agreement is binding upon your heirs and FNB BANK’s successors and assigns. Certain obligations of the parties pursuant to this Agreement that by their nature would continue beyond the termination, cancellation or expiration of this Agreement shall survive termination, cancellation or expiration of this Agreement. This Agreement constitutes the entire agreement between you and FNB BANK with respect to the subject matter hereof and there are no understandings or agreements relative hereto which are not fully expressed herein.

Definitions 

As used in this Agreement, the words “we,” “our,” and “us,” mean FNB BANK. “You” and “your” refer to the accountholder authorized by FNB BANK to use ONLINE BANKING under this Agreement and anyone else authorized by that accountholder to exercise control over the accountholder’s funds through ONLINE BANKING. “Account” or “accounts” means your accounts at FNB BANK. “Electronic funds transfers” means ATM withdrawals, preauthorized transactions, point of sale transactions, transfers to and from your FNB BANK accounts using ONLINE BANKING including bill payments. “ONLINE BANKING Services” means the services provided pursuant to this Agreement, including the FNB BILL PAYER. “Business days” means Monday through Friday. Federal holidays are not included.

Access

To use ONLINE BANKING, you must have at least one account at FNB BANK, access to Internet service, and an e-mail address. ONLINE BANKING can be used to access only the FNB BANK accounts which you have access to. You can add or delete any of your FNB BANK accounts from this Agreement by verbal or written notification. Access to your accounts through ONLINE BANKING will be based upon the identification of users and authority levels specified by you in your enrollment. We undertake no obligation to monitor transactions through ONLINE BANKING to determine that they are made on behalf of the accountholder. An account will stay on your ONLINE BANKING for 90 days after it has been closed. If you have not logged into your ONLINE BANKING for 180 days, your ONLINE BANKING access will be set to a dormant status and you will need to call Customer Service to remove the dormant status. If you have not accessed your ONLINE BANKING for 545 days, your ONLINE BANKING access will be terminated and you will need to re-apply for a new ONLINE BANKING account. Upon termination, all online services will be ceased including, but not limited to, the ability to view accounts, make transfers and view e-statements. E-statements will be converted to paper statements and subject to the paper statement fee.

ONLINE BANKING Services

You can use ONLINE BANKING to check the balance of your FNB Bank accounts, view FNB BANK account histories, transfer funds between your FNB BANK accounts, make stop payment requests, view checks, and download information about your accounts to financial money management software. You may also pay bills from your FNB BANK accounts in the amounts and on the dates you specify.

Hours of Access — You can use ONLINE BANKING seven days a week, twenty-four hours a day, although some or all ONLINE BANKING services may not be available occasionally due to emergency or scheduled ONLINE BANKING maintenance. We agree to post notice of any known extended periods of non-availability on the ONLINE BANKING Web site.

Your Password — For security purposes, you are required to change your Password upon your initial login to ONLINE BANKING. You determine what Password you will use and your Password is not communicated to us. You agree that we are authorized to act on instructions received under your Password. You accept responsibility for the confidentiality and security of your Password and agree to change your Password regularly. Upon three unsuccessful attempts to use your Password, your ONLINE BANKING account will be locked. You must contact us or select the self-reset link to have your account unlocked. 

We require that you create a password that utilizes both upper and lower case alphanumeric and special characters for purposes of security. Your password should not be associated with any commonly known personal identification, such as social security numbers, address, date of birth, names of children, and should be memorized rather than written down. 

Security — You understand the importance of your role in preventing misuse of your accounts through ONLINE BANKING and you agree to promptly examine your statement for each of your FNB BANK accounts as soon as you receive it. You agree to protect the confidentiality of your account and account number, and your personal identification information, such as your driver’s license number and social security number. You understand that personal identification information by itself, or together with information related to your account, may allow unauthorized access to your account. Your ONLINE BANKING Login ID and Password are intended to provide security against unauthorized entry and access to your accounts. Data transferred via ONLINE BANKING is encrypted in an effort to provide transmission security and ONLINE BANKING utilizes identification technology to verify that the sender and receiver of ONLINE BANKING transmissions can be appropriately identified by each other. Notwithstanding our efforts to ensure that the ONLINE BANKING is secure, you acknowledge that the Internet is inherently insecure and that all data transfers, including electronic mail, occur openly on the Internet and potentially can be monitored and read by others. We cannot and do not warrant that all data transfers utilizing FNB BANK ONLINE BANKING, or e-mail transmitted to and from us, will not be monitored or read by others. You are responsible for updating your computer and Wireless Device for latest release and/or patches. 

Fees and Charges — You agree to pay the fees and charges for your use of ONLINE BANKING services as set forth in the current fee schedule, which can be found at any bank location. You agree that all such fees and charges will be deducted from your FNB BANK Account. You agree to pay any additional reasonable charges for services you request which are not covered by this Agreement. You are also responsible for telephone, Internet service fees and/or mobile usage charges by the Wireless Device you incur in connection with your use of ONLINE BANKING.

Posting of Transfers — Transfers initiated through ONLINE BANKING before 4:00 p.m. (Mountain Time) on a business day are posted to your account the same day. Transfers completed after 4:00 p.m. (Mountain Time) on a business day, Saturday, Sunday, or Federal holiday, will be posted on the next business day. ONLINE BANKING identifies transfers based upon the ONLINE BANKING Login ID of the user who made the electronic transfer. 

Overdrafts (Order of Payments, Transfers, and other Withdrawals) — If your account has insufficient funds to perform all electronic fund transfers you have requested for a given business day, then:

  1. Electronic funds transfers involving currency disbursements, like ATM withdrawals, will have priority; 
  2. Electronic fund transfers initiated through ONLINE BANKING which would result in an overdraft of your account may, at our discretion, be cancelled;
  3. In the event the electronic fund transfers initiated through ONLINE BANKING which would result in an overdraft of your account are not cancelled, overdraft charges may be assessed pursuant to the terms of the deposit agreement for that account.

Stop-Payment Requests — Stopping the payment of a check is different from the cancellation of a bill payment. Once the bill payment has been debited from your account, you CANNOT cancel or stop a bill payment which has been paid electronically. You may be able to stop a FNB BILL PAYER payment paid by draft by contacting us by telephone before the draft has cleared. If the draft has not cleared, we will immediately process your stop-payment request. We will notify you immediately if the draft has already cleared. To be effective, this type of stop-payment request must precisely identify the name of the payee, the payee-assigned account number, the amount and scheduled date of the payment, and the confirmation number from the Bill Payment Screen.

You may initiate stop-payment requests online via ONLINE BANKING only for checks you have written (non-electronically) on your FNB BANK accounts (not FNB BILL PAYER drafts). Online stop-payment requests are processed at 9:00 a.m. (Mountain Time) on the business day following the date the stop-payment has been requested online. To be effective, this type of stop-payment request must precisely identify the name of the payee, the check number, the amount, and the date of the check. 

If you make your stop-payment request online or by telephone, we may also require you to put your request in writing and get it to us within 14 days after your request. You will incur stop-payment charges as disclosed in the current fee schedule for the applicable account. Stop-payment charges for FNB BILL PAYER drafts will be assessed in addition to the stop-payment charges for the applicable account.

Disclosure of Account Information and Transfers — You understand information about your accounts or the transfers you make may automatically be disclosed to others. For example, tax laws require disclosure to the government of the amount of interest you earn, and some transactions, such as large currency and foreign transactions, must be reported to the government. We may also provide information about your accounts to persons or companies we believe would use the information for reasonable purposes, such as when a prospective creditor seeks to verify information you may have given in a credit application or a merchant calls to verify a check you have written. In addition, we routinely inform credit bureaus when accounts are closed because they were not handled properly. We may also seek information about you from others, such as the credit bureau, in connection with the opening or maintaining of your account or in connection with approving your access to ONLINE BANKING. You agree and hereby authorize all of these transfers of information. 

Change in Terms — We may change any term of this Agreement at any time. If the change would result in increased fees for any ONLINE BANKING service, increased liability for you, fewer types of available electronic fund transfers, stricter limitations on the frequency or dollar amount of transfers, we agree to give you notice at least 30 days before the effective date of any such change, unless an immediate change is necessary to maintain the security of an account or ONLINE BANKING. We will post any required notice of the change in terms on the FNB BANK web site or forward it to you by e-mail or by postal mail. If advance notice of the change is not required, and disclosure does not jeopardize the security of the account or ONLINE BANKING, we will notify you of the change in terms within 30 days after the change becomes effective. Your continued use of any or all of the subject ONLINE BANKING services indicates your acceptance of the change in terms. We reserve the right to waive, reduce or reverse charges or fees in individual situations. You acknowledge and agree that changes to fees applicable to specific accounts are governed by the applicable deposit agreements and disclosures.

FNB Bill Payer

You must set up payee accounts with the complete name of the payee, the account number, and the payee's remittance address, all exactly as shown on the billing statement or invoice; the amount of the payment; and the date you want the payment to be processed. Payments will only be processed Monday through Friday excluding Federal Holidays. Funds sent electronically will be debited from your account the day the payment is processed. Funds sent by manual check will be debited from your account when the check clears the account. By using the FNB BILL PAYER option, you agree that, based upon instructions received under your Password, we can charge your designated account by electronic transfer, "no signature required draft", or by debiting and remitting funds on your behalf. If applicable, you also agree that your FNB BILL PAYER monthly fee will be charged to the designated account number set up for bill payment.

Scheduling FNB BILL PAYER Payments — If the payee is to be paid by check (as indicated on the Bill Payer list), you understand and agree that checks are mailed to the payee and the payee may not receive the payment for 7 to 10 business days after the date the payment is processed. If the payee is to be paid electronically (as indicated on the Bill Payer list), you understand and agree that the payee may not receive the payment for 3 to 4 days after the date the payment is electronically processed. You understand and agree that we are not responsible for the timely delivery of mail or the improper transmission or handling of payments by a third party such as the failure of the bill payment payee to properly post a payment to your account.

How to Cancel a Bill Payment — To cancel a bill payment that you have scheduled through FNB BILL PAYER, you must cancel the payment online via your FNB BILL PAYER before 6:00 a.m. (Mountain Time) on the date the payment is scheduled to be processed.

Mobile Banking 

When you enroll for ONLINE BANKING, one of the services available to you is our mobile banking services. Although mobile banking is a service of ONLINE BANKING, some features available through ONLINE BANKING may not be available with mobile banking. To utilize mobile banking, you will be required to install the software necessary to utilize the mobile banking app (the “Software”) on your compatible and supported mobile phone and/or other wireless device (each, a “Wireless Device”). By installing the Software and by using the mobile banking app, you agree to the terms and conditions set forth in this Agreement. You also agree that you are an authorized user of the Wireless Device you will use to access the mobile banking app and that you are authorized to download and install the Software on your Wireless Device. Once you have installed the required Software, designated accounts linked to your ONLINE BANKING Login ID and Password will be accessible through your Wireless Device. If you permit other persons to use your Wireless Device and ONLINE BANKING Login ID and Password or other means to access the mobile banking app, you are responsible for any transactions they authorize. You agree and understand that the mobile banking app may not be accessible or may have limited utility over some wireless networks. You accept responsibility for making sure that you know how to properly use your Wireless Device and the Software. We reserve the right to modify the scope of the mobile banking app at any time. We reserve the right to refuse to make any transaction you request through the mobile banking app. We will not be liable to you for any losses caused by your failure to properly use mobile banking or your Wireless Device.

Mobile Deposit

FNB Bank's Mobile Deposit service is designed to allow you to make deposits to your checking, savings, or money market savings accounts from home or other remote locations by capturing the image of a check and delivering the images and associated deposit information to FNB Bank or our designated processor. This service is available after your enrollment application has been accepted by us.

Eligible Items — You agree to scan and deposit only "checks" as that term is defined in Federal Reserve Regulation CC ("Reg. CC"). When the image of the check transmitted to FNB Bank is converted to an image for subsequent presentment and collection, it shall thereafter be deemed an "item" within the meaning of Articles 3 and 4 of the Uniform Commercial Code.

Ineligible Items — You agree that you will not scan and deposit any of the following types of checks or other items which shall be considered ineligible items:

  • Checks payable to any person or entity other than the person or entity that owns the account that the check is being deposited into.
  • Checks containing an alteration on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check is drawn.
  • Checks previously converted to a substitute check, as defined in Reg. CC.
  • Checks drawn on a financial institution located outside the United States.
  • Remotely created checks, as defined in Reg. CC.
  • Foreign items or checks not payable in United States currency.
  • Checks or items prohibited by the bank's current procedures relating to the services or which are otherwise not acceptable under the terms of your account.
  • Checks with any endorsement on the back other than that specified in this agreement.
  • Checks that have previously been submitted through the mobile banking app or through a remote deposit capture service offered at any other financial institution.
  • Checks that have previously been deposited or negotiated in any way via any method at FNB Bank or any other financial institution.
  • Rebate checks, money orders, or bonds.
  • Checks with misplaced, incomplete, or missing Magnetic Ink Character Recognition (MICR) Lines.

Endorsements and Procedures — You agree to restrictively endorse any item transmitted through the mobile banking app as "For FNB Bank Mobile Deposit Only, Account #______", along with the owner’s signature, or as otherwise instructed by FNB Bank. Endorsements should be made on the back of the check within 1 ½ inches from the top edge. You agree to follow any and all other procedures and instructions for use of FNB Bank’s Mobile Deposit service that FNB Bank may establish from time to time.

Receipt of Items — We reserve the right to reject any item transmitted through the mobile banking app, at our discretion, without liability to you. We are not responsible for items we do not receive or for images that are dropped during transmission. An image of an item shall be deemed received when you receive a confirmation from FNB Bank that we have received the image. Receipt of such confirmation does not mean that the transmission was error free, complete or will be considered a deposit and credited to your account. We further reserve the right to charge back to your account at any time, any item that we subsequently determine was not an eligible item. You agree that FNB Bank is not liable for any loss, costs, or fees you may incur as a result of our charge back of an ineligible item.

Availability of Funds — Checks deposited via the mobile banking app by FNB Bank's stated 3:00 p.m. (Mountain Time) deadline will be considered deposited on that business day and subject to the Funds Availability disclosure provided during account opening. Otherwise, we will consider that the deposit was made on the next business day we are open. Funds deposited using the mobile banking app will generally be made available on the first business day after the day of deposit.

Disposal of Transmitted Items — You agree never to re-present the item. You agree to retain the check for at least 30 calendar days from the date of the image transmission. After 30 calendar days, you agree to promptly destroy the check that you transmitted by shredding it, marking it “VOID”, or otherwise rendering it incapable of further transmission, deposit, or presentment. During the time the retained check is available, you agree to properly handle the check and upon request, promptly provide it to FNB Bank at your expense.

Deposit Limits — We reserve the right to and may establish limits on the dollar amount and/or number of items or deposits from time to time. If you attempt to initiate a deposit in excess of these limits, we may reject your deposit. If we permit you to make a deposit in excess of these limits, such deposit will still be subject to the terms of this Agreement, and we will not be obligated to allow such a deposit at other times.

Presentment — The manner in which the items are cleared, presented for payment, and collected shall be in FNB Bank's sole discretion subject to the agreements governing your account.

Duplicate Presentment of Checks — Once you have used the mobile banking app to deposit a check, you agree not to present, or allow anyone else to present, that original check or a substitute check again for deposit. A substitute check returned to you may only be deposited at a branch, night drop or drive-through location. Without our approval, you shall not attempt to deposit or otherwise negotiate an original check if has been charged back to you. You will be liable for checks that are presented and/or deposited more than once. If you or anyone else present a check for deposit more than once, in violation of this Agreement, you agree to indemnify, defend and hold the Bank harmless from and against all liability and damages that may result from any claims, suits or demands from third parties with respect to such check or substitute check. You agree that we may debit from your bank account for the aggregate amount of any checks that are deposited more than once. To the extent that funds in your account are insufficient to cover such amount, we shall debit the deficiency from any other of your account(s) with FNB Bank in our sole discretion. Intentional duplicate presentments may lead to termination of FNB Bank’s Mobile Deposit service and/or ONLINE BANKING.

Errors — You agree to notify FNB Bank of any suspected errors regarding items deposited through the mobile banking app immediately, and in no event later than 60 days after the applicable FNB Bank account statement is sent. Unless you notify FNB Bank within 60 days, such statement regarding all deposits made through the mobile banking app shall be deemed correct, and you are prohibited from bringing a claim against FNB Bank for such alleged error. 

Errors in Transmission — By using mobile banking you accept the risk that an item may be intercepted or misdirected during transmission. FNB Bank bears no liability to you or others for any such intercepted or misdirected items or information disclosed through such errors.

Image Quality — The image of an item transmitted to FNB Bank using the mobile banking app must be legible, as determined in the sole discretion of FNB Bank. Without limiting the foregoing, the image quality of the items must comply with the requirements established from time to time by FNB Bank, the Board of Governors of the Federal Reserve Board, or any other regulatory agency, clearinghouse or association.

User Warranties and Indemnification — You warrant to FNB Bank that:

  • You will only transmit eligible items.
  • You will not transmit duplicate items.
  • You will not re-deposit or re-present the original item.
  • All information you provide to FNB Bank is accurate and true.
  • You will comply with this Agreement and all applicable rules, laws, and regulations.
  • You are not aware of any factor which may impair the collectability of the item being deposited.
  • You agree to indemnify and hold harmless FNB Bank from any loss for breach of this warranty provision.
  • Files and images transmitted to us will contain no viruses or any other disabling features that may have an adverse impact on our network, data, or related systems.

Cooperation with Investigations — You agree to cooperate with us in the investigation of unusual transactions, poor quality transmissions, and resolution of customer claims, including by providing, upon request and without further cost, any originals or copies of items deposited through the mobile banking app in your possession and your records relating to such items and transmissions. If warranted in our reasonable judgment, we may audit and monitor you, and you agree to cooperate with us to permit such monitoring, to confirm that you have satisfied your obligations under this Agreement.

Termination — We may terminate this service at any time, for any reason, and without notice. We may suspend or terminate this service for reasons including but not limited to:

  • if we suspect fraud
  • if you misuse FNB Bank’s Mobile Deposit service
  • if you deposit items more than once
  • if you do not notify us of a known error
  • if you have excessive overdrafts or returned items

Electronic Funds Transfers

Your rights and obligations regarding Electronic Funds Transfers can be found at any of our branch locations or in the deposit agreement provided at account opening.

Disclaimer of Warranty and Limitation of Liability

We make no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, in connection with the ONLINE BANKING services provided to you under this Agreement. We do not and cannot warrant that ONLINE BANKING will operate without errors, or that any or all ONLINE BANKING services will be available and operational at all times. Except as specifically provided in this Agreement, or otherwise required by law, you agree that our officers, directors, employees, agents or contractors are not liable for any indirect, incidental, special or consequential damages under or by reason of any services or products provided under this Agreement or by reason of your use of or access to ONLINE BANKING, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty. Further, in no event shall the liability of FNB BANK and its affiliates exceed the amounts paid by you for the services provided to you through ONLINE BANKING.

Termination

Your Right to Terminate — You may cancel your ONLINE BANKING service at any time by providing us with written notice by postal mail, fax, or in person at one of our branch locations. Your access to ONLINE BANKING will be suspended within 3 business days of our receipt of your instructions to cancel the service. You will remain responsible for all outstanding fees and charges incurred prior to the date of cancellation.

Our Right to Terminate — You agree that we can terminate or limit your access to ONLINE BANKING services for any of the following reasons:

  1. Without prior notice, if you have insufficient funds in any one of your FNB BANK accounts. ONLINE BANKING service may be reinstated, at our sole discretion, once sufficient funds are available to cover any fees, pending transfers, and debits. 
  2. Repeated instances of suspected fraud due to supplying your ONLINE BANKING user ID and password to an unknown person, or persons. will result in immediate termination of your access.
  3. Upon reasonable notice, for any other reason at our sole discretion.
